These Terms and Conditions of Use, together with any applicable order forms, subscriptions, policies, or agreements referenced herein, govern your access to and use of Quick811, including our websites, software, dashboards, maps, ticket tracking tools, automated update tools, notes, notifications, reports, APIs, and related services.

Quick811 may be referred to in these Terms as "Quick811," "Company," "we," "our," or "us." The customer, account holder, company, organization, employee, contractor, subcontractor, administrator, user, or other party accessing or using Quick811 may be referred to as "you," "your," or "User."

By creating an account, subscribing to Quick811, accessing the platform, or using any Quick811 service, you agree to these Terms. If you do not agree to these Terms, you should not use Quick811.

1. Purpose of Quick811

Quick811 is a contractor-focused software platform built to help contractors organize, visualize, manage, and track 811 locate tickets, jobs, responses, notes, and related workflow information.

Quick811 is designed to make 811 ticket management easier by helping users see ticket information in one place, view work areas visually, monitor ticket statuses, reduce administrative friction, and keep crews better organized.

Quick811 is not a utility locating company, one-call center, engineering firm, surveying company, legal advisor, or safety authority.

Quick811 does not physically mark utilities, verify underground utility locations, approve excavation, or guarantee that a worksite is safe to dig.

2. Acceptance of Terms

By using Quick811, you agree that you:

  • Have read and accepted these Terms.
  • Are at least 18 years old.
  • Are authorized to use Quick811 on behalf of yourself, your company, or your organization.
  • Are authorized to bind your company or organization to these Terms if using Quick811 for business purposes.
  • Will comply with all applicable laws, rules, regulations, one-call requirements, excavation requirements, and safety standards.
  • Will use Quick811 only for lawful business purposes.

Each time you access or use Quick811, you confirm your continued acceptance of these Terms.

3. User Responsibilities

You are responsible for all information submitted, uploaded, entered, imported, forwarded, received, edited, or stored through Quick811.

You agree to:

  • Provide accurate, complete, and current information.
  • Verify job information, ticket information, work locations, dates, scopes, contact details, and excavation areas.
  • Review all ticket statuses and utility responses before beginning work.
  • Confirm that all required locates, remarks, clearances, positive responses, and legal requirements have been satisfied.
  • Maintain your own records as required by law, contract, company policy, or project requirements.
  • Ensure that your crews, subcontractors, employees, and representatives are properly trained and informed.
  • Use Quick811 as an organizational tool, not as the sole source of truth for excavation safety.

Quick811 does not relieve you of your responsibility to follow applicable 811 laws, state requirements, utility owner instructions, project specifications, permit conditions, or safe excavation practices.

4. 811 Tickets, Locates, and Excavation Responsibility

You acknowledge and agree that excavation work involves serious risk, including damage to underground utilities, property damage, service interruptions, injury, death, regulatory penalties, project delays, and financial losses.

Quick811 does not determine whether excavation may legally or safely begin.

Before beginning excavation, you are solely responsible for verifying:

  • The correct ticket has been created or submitted.
  • The ticket covers the full scope of work.
  • The work area is accurately described and mapped.
  • The ticket is active and not expired.
  • All required waiting periods have passed.
  • All utilities have responded as required.
  • The worksite has been properly marked.
  • Any no-response, unclear response, conflict, mismatch, or field concern has been resolved.
  • Your crew understands the limits of the ticket and marked area.
  • All applicable potholing, hand digging, tolerance zone, and safety rules are followed.

Quick811 is not responsible for your decision to excavate, delay, proceed, stop work, continue work, or interpret ticket information.

5. Utility Marking and Third-Party Information Disclaimer

Quick811 may display or organize information from users, emails, 811 centers, utility owners, positive response systems, third-party portals, APIs, maps, attachments, uploaded files, or other external sources.

Quick811 does not guarantee the accuracy, completeness, timeliness, legality, reliability, or availability of any third-party information, including:

  • Utility markings
  • Positive responses
  • Ticket statuses
  • Ticket expiration dates
  • Work area boundaries
  • Maps or polygons
  • Utility owner responses
  • Clear or no-conflict responses
  • Marked or unmarked facilities
  • Delayed, missing, incomplete, incorrect, or conflicting responses

You acknowledge that utility markings may be inaccurate, incomplete, delayed, missing, mismatched, or misunderstood.

You remain solely responsible for field verification, safe excavation practices, and compliance with applicable requirements.

6. Map, Polygon, and Location Disclaimer

Quick811 may include map-based tools, polygons, address data, job boundaries, visual ticket areas, location pins, or other geographic information. These map features are provided for convenience and workflow organization only.

Quick811 does not guarantee that:

  • A displayed polygon matches the legally submitted ticket scope.
  • A map boundary is complete or accurate.
  • A pin, route, address, or work area is correctly placed.
  • A visual display includes every affected utility or excavation area.
  • A map view can be relied upon as the final authority for excavation.

You are responsible for confirming all worksite locations, ticket boundaries, addresses, GPS coordinates, job limits, station ranges, and excavation areas before work begins.

7. Automated Ticket Updates and Notifications

Quick811 may provide automated ticket tracking, email parsing, forwarded ticket ingestion, status updates, reminders, notes, alerts, reports, or other automation features.

These features may depend on third-party systems, email delivery, user-provided data, utility responses, one-call center availability, APIs, internet access, parsing logic, and external platforms outside Quick811's control.

Quick811 does not guarantee that automated updates, reminders, or notifications will be complete, accurate, immediate, uninterrupted, or error-free.

You are responsible for manually verifying ticket information when needed, especially before making excavation decisions.

8. User Accounts and Access

You are responsible for maintaining the confidentiality of your login credentials, account access, company workspace, invited users, and permissions.

You agree to:

  • Keep account credentials secure.
  • Notify Quick811 if you suspect unauthorized access.
  • Ensure users in your company account are authorized.
  • Remove access for employees, subcontractors, or representatives who should no longer have access.
  • Accept responsibility for activity occurring under your account.

Quick811 is not responsible for losses caused by unauthorized access resulting from your failure to protect credentials, manage users, or maintain proper internal controls.

9. Company Workspaces and Authorized Users

If you create or join a company workspace within Quick811, you represent that you are authorized to access, manage, upload, edit, or view information for that company.

Company administrators may have access to user activity, tickets, jobs, notes, settings, reports, and other workspace information.

You are responsible for ensuring that all users invited to your company workspace have appropriate authorization to view or manage the information available to them.

10. Subscription, Billing, and Payment

Certain Quick811 features may require a paid subscription or usage-based billing.

By subscribing to a paid plan, you agree to pay all applicable subscription fees, usage fees, ticket-based fees, taxes, and other charges associated with your account.

Unless otherwise stated:

  • Subscription fees may be billed monthly or annually.
  • Usage-based fees may be billed according to ticket volume, automation usage, feature usage, or other plan terms.
  • Fees are non-refundable except where required by law or expressly agreed in writing.
  • Quick811 may suspend or terminate access for failed, late, disputed, or unpaid invoices.
  • Plan features and pricing may change with notice.

You are responsible for reviewing your selected plan, billing terms, usage, and charges.

11. Free Trials, Free Plans, and Beta Features

Quick811 may offer free plans, trial access, beta features, early access tools, or experimental functionality. These features may be limited, modified, discontinued, or removed at any time.

Beta and trial features are provided for testing and evaluation only and may contain bugs, errors, incomplete functionality, or inaccurate outputs.

Quick811 is not liable for losses or damages resulting from reliance on beta, trial, or experimental features.

12. Acceptable Use

You agree not to use Quick811 to:

  • Violate any law, regulation, contract, or third-party right.
  • Submit false, misleading, fraudulent, or unauthorized information.
  • Interfere with or disrupt Quick811's systems.
  • Attempt to gain unauthorized access to accounts, data, systems, or networks.
  • Reverse engineer, copy, scrape, resell, or exploit Quick811 without written permission.
  • Upload malicious code, viruses, harmful files, or unlawful content.
  • Use Quick811 in a manner that could damage, disable, overload, or impair the platform.
  • Misrepresent Quick811's role in your excavation, ticketing, or compliance process.
  • Claim that Quick811 approved, verified, cleared, or authorized excavation.

Quick811 may suspend or terminate accounts that violate these Terms.

13. Customer Data

You retain ownership of information, files, ticket data, notes, project information, company information, and other materials you submit to Quick811.

By using Quick811, you grant Quick811 permission to store, process, transmit, display, analyze, and use your submitted data as necessary to provide, maintain, secure, improve, and support the platform.

You represent and warrant that you have the right to submit all information provided to Quick811 and that such information does not violate any law, contract, confidentiality obligation, or third-party right.

Quick811's use of customer data is also governed by our Privacy Policy.

14. Privacy

Your use of Quick811 may involve the collection and processing of account information, company information, usage data, ticket data, emails, uploaded files, job information, and other information.

By using Quick811, you agree to the practices described in the Privacy Policy.

15. Third-Party Services and Integrations

Quick811 may interact with or rely on third-party services, including but not limited to:

  • Email providers
  • 811 centers
  • Utility portals
  • Mapping providers
  • Payment processors
  • Hosting providers
  • APIs
  • Analytics providers
  • Communication tools

Quick811 is not responsible for third-party services, including their availability, accuracy, security, policies, data, delays, errors, outages, or failures.

If you connect, forward, upload, or provide information from a third-party service, you authorize Quick811 to access, process, store, and use that information as needed to provide the platform.

You are responsible for complying with the terms, policies, and legal requirements of any third-party services you use in connection with Quick811.

16. Third-Party Account Information

If you provide login credentials, API keys, forwarded emails, access tokens, or other third-party account information to Quick811, you represent that you have authority to do so.

You authorize Quick811 to use that information solely as needed to provide requested features or services.

Quick811 is not responsible for errors, delays, account restrictions, access failures, lost information, incorrect information, third-party fees, or other issues resulting from third-party systems or user-provided account information.

17. Intellectual Property

Quick811, including its software, design, workflows, user interface, code, branding, logos, graphics, features, content, documentation, processes, and other proprietary materials, is owned by Quick811 or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, display, sell, resell, license, reverse engineer, or create derivative works from Quick811 without prior written permission.

No rights are granted to you except the limited right to use Quick811 according to these Terms and your subscription plan.

18. Feedback

If you provide suggestions, ideas, improvements, comments, feature requests, or other feedback about Quick811, you grant Quick811 the right to use that feedback without restriction or compensation.

Quick811 may use feedback to improve, modify, market, or develop the platform.

19. No Warranty

Quick811 is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Quick811 disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

Quick811 does not warrant that:

  • The platform will be error-free or uninterrupted.
  • Ticket information will always be current or accurate.
  • Automations will always function correctly.
  • Third-party information will be complete or reliable.
  • Maps or locations will be accurate.
  • The platform will prevent downtime, damages, missed locates, expired tickets, project delays, or utility strikes.

Your use of Quick811 is at your own risk.

20. Limitation of Liability

To the fullest extent permitted by law, Quick811 shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or related to your use of Quick811.

This includes, without limitation, damages related to:

  • Utility strikes
  • Underground infrastructure damage
  • Property damage
  • Personal injury
  • Death
  • Project delays
  • Lost profits
  • Lost revenue
  • Lost business opportunities
  • Service interruptions
  • Missed ticket updates
  • Incorrect ticket information
  • Expired tickets
  • Inaccurate maps
  • Third-party system failures
  • Regulatory fines
  • Legal disputes
  • Excavation decisions
  • Data loss
  • Unauthorized access

Your sole remedy for dissatisfaction with Quick811 is to stop using the platform.

Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.

21. Release of Liability

You release Quick811, its owners, officers, directors, employees, contractors, vendors, affiliates, agents, licensors, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising out of or related to:

  • Your excavation work
  • Your use of ticket information
  • Your reliance on Quick811
  • Your failure to verify information
  • Utility marking errors or omissions
  • Third-party delays or failures
  • Work performed by your crews, subcontractors, employees, or representatives
  • Any damage to underground infrastructure, property, or persons

22. Indemnification

You agree to defend, indemnify, and hold harmless Quick811, its owners, officers, directors, employees, contractors, vendors, affiliates, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, penalties, fines, and attorneys' fees arising out of or related to:

  • Your use of Quick811
  • Your excavation activities
  • Your violation of these Terms
  • Your violation of any law, regulation, permit, contract, or third-party right
  • Your submitted data or project information
  • Your failure to verify ticket information
  • Damage to underground infrastructure
  • Claims by utility owners, customers, general contractors, subcontractors, municipalities, agencies, property owners, or third parties
  • Actions or omissions by your employees, crews, subcontractors, representatives, or invited users

Quick811 reserves the right to assume control of the defense of any claim subject to indemnification, and you agree to cooperate in such defense.

23. Service Availability

Quick811 may be unavailable from time to time due to maintenance, updates, outages, internet issues, hosting failures, third-party interruptions, security events, or other causes.

Quick811 does not guarantee uninterrupted access to the platform.

Quick811 may modify, suspend, discontinue, or limit any feature, service, plan, or functionality at any time.

24. Termination and Suspension

Quick811 may suspend or terminate your account or access to the platform at any time if:

  • You violate these Terms.
  • You fail to pay required fees.
  • Your use creates risk for Quick811, other users, or third parties.
  • You misuse the platform.
  • Required by law, regulation, court order, or third-party provider.
  • Quick811 discontinues the service or a portion of the service.

You may stop using Quick811 at any time.

Cancellation terms may depend on your subscription plan, billing cycle, and any applicable written agreement.

Upon termination, your right to access Quick811 ends immediately.

Certain provisions of these Terms will survive termination, including ownership, disclaimers, limitation of liability, release, indemnification, and payment obligations.

Updated Terms may be posted on the Quick811 website or provided through the platform, email, or other reasonable notice.

Your continued use of Quick811 after updated Terms become effective means you accept the updated Terms.

If you do not agree to updated Terms, you should stop using Quick811.

26. Governing Law

These Terms shall be governed by the laws of the State of Michigan, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or Quick811 shall be brought in the state or federal courts located in Oakland County Michigan, unless otherwise required by applicable law.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

28. Entire Agreement

These Terms, together with any applicable Privacy Policy, subscription terms, order forms, invoices, or written agreements between you and Quick811, constitute the entire agreement between you and Quick811 regarding your use of the platform.

These Terms supersede any prior or contemporaneous understandings, communications, or agreements regarding the subject matter herein.
